RECENT CRIMINAL DEFENSE CASE RESULTS

Once a criminal case is filed, there are 2 general stages: Pre-trial and Trial. Since the vast majority of cases are settled in the pre-trial phase, it is important to have an attorney who not only is capable of representing you in front of a jury, but can also negotiate with the prosecutor to attempt to reach a fair and just resolution before it ever gets to a jury.


CASE RESULTS

PC 11370.1(a): Possession of Controlled Substance with Firearm; PC 29800(a)(1): Possession of Firearm by a Felon; PC 30305(a)(1): Possession of Ammunition

Los Angeles Superior Court: People v. D.Q.

Outcome: Mental Health Diversion Motion GRANTED; all charges dismissed.

Case details: We were able to obtain Mental Health Diversion for this client, allowing him to avoid conviction of 3 felonies.

PC 242: Battery

Los Angeles Superior Court: People v. F.H.

Outcome: Judicial Diversion Motion GRANTED; all charges dismissed.

Case details: We were able to obtain Judicial Diversion for this client, allowing her to avoid conviction entirely.

PC 25400(a)(1): Carrying a Concealed Firearm in a Vehicle: PC 25850(a): Carrying a Loaded Firearm in a Vehicle

Los Angeles Superior Court: People v. R.W.

Outcome: Judicial Diversion Motion GRANTED; all charges dismissed.

Case details: We were able to obtain Judicial Diversion for this client, who was a college student and athlete allowing his record to remain clear, and to avoid conviction entirely.

H&S 11351: Possession for Sale of a Controlled Substance

Los Angeles Superior Court: People v. B.K.

Outcome: Informal Diversion – all charges dismissed.

Case details: This client had a record and multiple open cases. We were able to secure an agreement to informal diversion, allowing for dismissal of the charges.

PC 273.5 – Domestic Violence

Los Angeles Superior Court: People v. Y.J.

Outcome: Charges reduced to PC 415 – Disturbing the Peace, as an INFRACTION.

Case details: Client had an open immigration case. Following conversations with the District Attorney, client pleaded to 1 infraction. No immigration consequences.

PC 242 – Battery

Los Angeles Superior Court:  People v. F.H.

Outcome:  Judicial Diversion granted over the prosecutor’s objection.  Charges dismissed after diversion.

Case details:  Client was charged with battery.  Over the prosecutor’s objection, the Judge granted our motion for judicial diversion, which leads to all charges being dismissed.

Civil Harassment Restraining Order – Respondent’s side

Orange County Superior Court

Outcome:  Restraining Order denied after hearing.

Case details:  Our client was involved in a neighbor dispute, leading to the neighbor filing a restraining order against him.  After a full day’s hearing, the order was denied.

Domestic Violence Restraining Order – Petitioner’s side

Los Angeles Superior Court

Outcome:  Restraining Order granted.

Case details:  Our client was being harassed by her former boyfriend.  After hearing, the order was granted, along with attorneys’ fees granted to our client, and an order that the abuser attend domestic violence classes.

Motion to Vacate Conviction – People v. M.G.

San Luis Obispo Superior Court:  People v. M.G.

Outcome:  Motion Granted – Conviction vacated

Case details:  Client was being held by D.H.S., and needed his old felony conviction vacated.  We were able to prove that client was not fully advised of immigration consequences of his guilty plea.

Los Angeles Superior Court: People v. J.J.

Penal Code 29800: Felon in Possession of a Firearm; Penal Code 417 – Brandishing a Firearm.

Outcome: Case Dismissed after Hung Jury

Client was charged with possession of a firearm while on federal probation, and was looking at a 5 year sentence. The trial ended in a hung jury with 9 votes for Acquittal, and 3 for Guilty. The case was dismissed shortly after.

Los Angeles Superior Court: People v. X.X.

Penal Code 653.22: Loitering to Commit Prostitution

Outcome: Bench Warrant Recalled and Case Dismissed

My client was a victim of human trafficking. We were able to convince the Court to recall a 10 year old bench warrant, and dismiss the case entirely, without an appearance from the defendant.

Los Angeles Superior Court: People v. S.S.

Penal Code 4384E(c): Theft; Penal Code 484G(a): Theft; Penal Code 484(a): Theft; Penal Code 602(m): Trespass:

Outcome: All charges dismissed.

We were able to arrange a diversion agreement, resulting in the dismissal of all charges against this client.

VC 23152: Driving Under the Influence with high Blood Alcohol Content enhancement; VC 20002(a): Hit and Run

Los Angeles Superior Court: People v. N.O.

Outcome: Case dismissed in its entirety.

Client was charged with DUI and Hit & Run, with a sentencing enhancement for a .24 BAC. Hit & Run dismissed pre-trial over prosecutor’s objection. DUI charge dismissed on eve of trial following motions to exclude evidence.

PC 530.5(a): Identity Theft, a felony; PC 459: Commercial Burglary, a felony; PC 470b: Possession of a Forged Driver’s License, a felony

Los Angeles Superior Court: People v. G.J.

Outcome: All felonies dismissed; Client pleads to one count of shoplifting.

Client was charged with three serious felonies, with immigration consequences. Upon a showing of mitigation evidence, the prosecutor agreed to dismiss all charges, and allow a plea to one count of shoplifting, as a misdemeanor. Client not deported.

PC 25400(a)(1): Having a Concealed Firearm in a Vehicle, a felony; PC 25850(a): Carrying a Loaded, Unregistered Handgun, a felony; PC 32310(a): Possession of a Large-Capacity Magazine, a felony; PC 148.9(a): Giving False Information to a Police Officer, a misdemeanor.

Los Angeles Superior Court: People v. D.M.

Case details: Client was charged with multiple firearm felonies. We were able to secure a deal for a plea to PC 25400(a)(1) as a misdemeanor. Remaining charges dismissed. Summary probation, no jail time.

PC 166(a)4: Disobeying a Court Order; PC 273.6(a): Disobeying a Protective Order; PC 243(e)(1): Domestic Battery; PC 484(a): Theft

Los Angeles Superior Court: People v. Y.U.

Case details: Plea to 1 count of Violating a Temporary Restraining Order. All other charges dropped. Summary probation, no jail time.

Unemployment Insurance Code 2116(b): Disability Insurance Fraud, PC 487(a): Grand Theft, and PC 550(a)(1): Insurance Fraud – all Felonies

Los Angeles Superior Court: People v. A.A.

Outcome: All 3 charges dropped. One count of PC 550(a)(6) added, to allow Client to reduce the charge to a misdemeanor. 6 months probation, and 10 days community service. No jail time.

Case details: This Client was charged with 3 felonies for allegedly fraudulently receiving approximately $40,000 in disability and unemployment insurance benefits. We were able to dismiss the 3 original charges, and amend the Complaint to add a charge of PC 550(a)(6), which allows the charge to be reduced to a misdemeanor.

VC 20002(a): Misdemeanor Hit & Run

Los Angeles Superior Court: People v. M.H.

Outcome: Complete dismissal of all charges (including suspended fine).

Case details: This case was completely dismissed early on in the proceedings, without even the necessity of paying the victim an extortionate amount for a civil compromise.

PC 653.22(a): Prostitution, PC 22615(b): Sale of a Stun Gun without a Serial Number

Orange County Superior Court: People v. A.M.

Outcome: Both charges dismissed.

Case details: My Client was found to be the victim in this unfortunate situation. Both charges were dismissed and the case was dropped.

Case 1: PC 273.5: Corporal Injury on a Cohabitant

Case 2: PC 422: Criminal Threats, PC 653m: Annoying Phone Calls (2 counts), PC 417: Brandishing a Weapon, Gun, or Firearm, PC 240: Assault, PC 602.5: Criminal Trespass, PC 273.6: Violating a Protective Order

Los Angeles Superior Court: People v. K.C.

Outcome: Case 1 dismissed; Case 2: All charges dismissed except for one count of Annoying phone Calls and one count of Trespass. Client agreed to undergo mental health and anger management counseling. Summary probation, no jail time.

Case details: Client had an outstanding warrant from an old criminal complaint, and picked up a new case in the meantime, with seven counts. The old case was dismissed. In the new case, Client agreed to undergo mental health and anger management counseling, and was sentenced to informal probation – no jail time.

12 counts of PC 471.5: Altering a Medical Record with Fraudulent Intent

San Bernardino Superior Court: People v. X.X.

Outcome: Deferred Entry of Judgment leading to dismissal of entire case.

Case details: This client was a Registered Nurse, with 12 misdemeanor counts against her, threatening to jeopardize her career. We were able to arrange for the charges to be dismissed in full.

VC 23152(a) & 23152(b): Misdemeanor Driving Under the Influence of Alcohol & with a BAC of Greater than .08

Los Angeles Superior Court: People v. J.V.

Outcome: Charges reduced to reckless driving – 3 years informal probation.

Case details: This client had an extensive criminal record (including a previous drunk driving conviction), and was accused of driving with a BAC of 0.14. We were able to reduce the charge to a wet reckless, with summary probation.

PC 148.9(a): Falsely Representing Self to a Police Officer

Orange County Superior Court: People v. L.M.

Outcome: Charge dismissed.

Case details: This Client was cited for jaywalking, and then allegedly provided false identifying information to the police officer. We were able to get the misdemeanor and the jaywalking infraction dismissed.

PC 484: Misdemeanor Petty Theft

Los Angeles Superior Court: People v. D.F.

Outcome: Complete dismissal of all charges pending online shoplifting class completion

Case details: Client apprehended by security guard in the process of stealing merchandise. We arranged for the Client to take one online class, after which all charges were dismissed.

B&P 25662: Minor in Possession of Alcohol

Los Angeles Superior Court: People v. R.W.

Outcome: Case dismissed.

Case details: Client, a college student, was accused of drinking in a public location. Case dismissed.

H&S 11357: Possession of Marijuana

San Bernardino Superior Court: People v. N.T.

Outcome: Deferred entry of judgment leading to complete dismissal.

H&S 11359: Felony Possession of Marijuana for sale

Los Angeles Superior Court: People v. R.R.

Outcome: Charges reduced to PC 32: Misdemeanor Accessory after the Fact. Probation only.

Case details: This Client was charged with marijuana sales. He had large quantities of marijuana in his car, along with paraphernalia indicating sales. In addition, he was not a citizen and sought to avoid a drug related conviction. We were able to reduce the charges to PC 32, with no mention of any drug offense on his record. Client was able to maintain U.S. residency.

PC 246.3: Unlawful Discharge of a Firearm in a Grossly Negligent Manner; andLAMC 55.00: Discharge of a Firearm without a Permit

Los Angeles Superior Court: People v. J.J.

Outcome: Summary probation; 20 days community service; no jail time.

Case details: This Client was charged with negligently discharging a firearm, and faced jail time as a repeat offender. We were able to negotiate a reduced charge with probation and community service only.

VC 23152(a) & VC 23152(b): Driving Under the Influence of Alcohol; and VC 12500: Driving without a License

Los Angeles Superior Court: People v. C.E.

Outcome: Summary probation and alcohol class; no jail time; no community labor; no AA meetings; no enhancement for high BAC; VC 12500 dismissed.

Case details: Client was charged with a DUI with a BAC of over .20, and driving without a California license, a misdemeanor.

VC 23152(a) & VC 23152(b): Driving Under the Influence of Alcohol; and VC 16028(c): Accident with no Proof of Insurance

Los Angeles Superior Court: People v. C.R.

Outcome: Summary probation and alcohol class; no jail time; community labor stayed; no enhancement for high BAC; VC 16028(c) dismissed.

Case details: Client was charged with a DUI with a BAC of over .20, getting into an accident without providing insurance, and Failure to Appear. We were able to negotiate a standard first time DUI, and a stay of community labor.

VC 23152(a) and VC 23152(b): Driving Under the Influence of Alcohol

Los Angeles Superior Court: People v. D.H.

Outcome: Charges reduced to VC 23109(c): Exhibition of Speed. 2 years summary probation; no alcohol; no license suspension.

Case details: Client was pulled over for driving with no license plate and expired registration, and charged with DUI. Case settled right before jury selection.

PC 647(f): Public Intoxication

Orange County Superior Court: People v. N.S.

Outcome: Charge reduced to infraction.

Case details: Mitigation evidence presented to the prosecutor, persuading him to reduce the charge to an infraction.
